Dear client! Please read it! It is important ! While receiving a package (by DHL or DPD Courier) please check in the courier’s presence that the package is in appropriate condition and its contents weren’t damaged during the transport. In case of the package seeming damaged, please lodge a complaint immediately and demand the damage protocol from the courier. Without such a protocol, later we won’t be taking any complaints about the damages that might have taken place in the transport process.
GENERAL CONDITIONS
1. Internet shop of ELGRA W. E. Kubik unlimited company (further on ELGRA), elgracool.com enables purchasing products via Internet. 2. The prices that appear in the shop elgracool.com are displayed in Polish Zloty (PLN) and Euro (EUR). After putting products into shopping basket, we can see their price along with the tax. 3. The prices of transport are gross prices displayed with the tax.
THE PROCEDURE OF SUBMIT & REALIZATION OF THE ORDERS
4. User’s address, e-mail and telephone number which are provided; can be used to fulfill the order. 5. The basic condition of fulfilling the order is the valid order form (displayed on elgracool.com internet shop), filled by the client while placing an order. 6. In case of being unable to fulfill the order at present time or at all, ELGRA reserves the right to halt the fulfillment of the order- the client should be informed about the situation immediately. 7. Incorrectly filled order forms won’t be considered. 8. Bought products are delivered to the address provided in the order form. 9. The client has a right to choose preferred way of transport, accordingly to the order form. 10. The transport costs are added to the invoice in a separate item: transport. In specific cases, allowed by ELGRA , the payment for the transport can be aqcuited by ELGRA.
RETURN OF NOT DELIVERED PRODUCTS
11. In case of a parcel return (won’t be received in time, the client refuses to receive it etc.) the client will have to confirm any new order by telephone. Warning: We won’t cooperate further with clients who haven’t received two packages in the history of their orders.
GUARANTEES & COMPLAINTS
12. Products offered in ELGRA are covered with producer’s warranty and delivered with appropriate warranty cards. 13. In case of lodging a complaint a client should contact ELGRA to discuss the way of fulfillment of the warranty rights. 14. The client has a right to withdraw from the contract without stating the cause in 10 days time from placing an order. 15. We take the return of the ordered product only if it wasn’t spoiled in any way by the client. The product cannot have any signs of being used, cannot be damaged, tested or rid of original wrapping. 16. The cost of wrapping and sending the product back is be taken by the client. 17. Please secure the package that is sent back, so that it won’t take any damage - product should be received in a state it was sent to the client - only then we can take the return. 18. We do not receive packages by cash on delivery. 19. In case of positively considered return, we transfer the sum to a bank account.
FINAL RESOLUTIONS
19. In cases not described by this statute, the Polish Civil Code and Act on the protection of certain consumer rights and on the liability for damage caused by a dangerous product (Official Journal of Laws No 22 of 31 March 2000, item 271) are applicable.
We reserve the right to cancel the “wholesaler status” in our shop elgracool.com without stating a reason.
